The BMC order, according to the court, was “clearly a misuse of the law and bona fide.”

The petitioners, the Thackeray-led Shiv Sena, were, according to Sada Sarvankar, a Dadar MLA and member of the Shinde group, seeking to claim the party under the pretence of the current lawsuit.

The verdict was praise by the Thackeray-led Shiv Sena, which also expresse happiness that the judiciary has upheld. The gathering this year, according to party spokeswoman Manisha Kayande, will be spectacular.

She argued that there was probably some pressure on the Mumbai Municipal Corporation (BMC), which had rejected the approval.

“Our confidence in the legal system is confirm. For many years, the Dussehra celebration has taken place at “Shiv-tirtha,” as the Sena calls Shivaji Park, but this year, the Shinde group and the BJP attempted to erect obstacles. Thankfully, the court dismissed it, “said Sena secretary Vinayak Raut.

The Shiv Sena has organised a rally on Dussehra each year since 1966. This year’s demonstration is notable since Sena is now split into two sections and it was postponed in 2020 and 2021 because to the Covid-19 epidemic.

In an attack on Mr. Shinde in August, Uddhav Thackeray claim that the party was uncertain as to whether it will be grant permission for the event. Mr. Thackeray went on to say that he will have a Dussehra protest at Shivaji Park regardless of what happened.
